COMMERCIAL FOLLOW-ON / BEMITIL / ME/CFS

HEAT FIRST.
RECOVERY NEXT.

Can Bemitil change the biology of post-exertional recovery? Our commercial follow-on concept is a Bemitil-derived development program for ME/CFS-associated post-exertional malaise, earned through disease-relevant evidence after the lead gates.

01 / RENZ-POLSTER / HYPOTHESIS

A question about failed adaptation

Herbert Renz-Polster proposes that impaired protective stress responses in the central nervous system may sustain ME/CFS and delayed deterioration after exertion. This is a disease hypothesis, not an established cause or a Bemitil treatment study. It motivates our follow-on question; it does not answer it.

02 / PRIMARY HUMAN RESEARCH

An observable molecular problem

Van Booven et al. (2023) report altered exercise/recovery transcriptomic responses in women with ME/CFS. Vu et al. (2024) studied 30 patients and 28 controls and found cell-specific dysregulation, including persistent monocyte changes and post-exercise platelet differences. These studies neither tested Bemitil nor establish a universal expression signature or a CNS cause.

03 / BEMITIL / THE BRIDGE TO TEST

Does a molecular response improve recovery?

Bemitil’s rat hypoxia literature supplies an indirect RNA-dependent antioxidant lead. Our inference is to investigate whether a reproducible Bemitil response has relevance to disease-associated stress biology. Peripheral expression measurements alone cannot establish correction of a central nervous system defect, and a heat-performance result cannot establish ME/CFS efficacy.

04 / TARGET PRODUCT CONCEPT

Reduce the cost of exertion

The clinical objective would be less post-exertional symptom worsening, shorter recovery and better daily function. Increased peak output alone would not count as success. A disease program needs specialist-led safety assessment and patient-appropriate endpoints, with close attention to delayed worsening. A future patient program requires its own specialist-led design and regulatory review.

05 / COMMERCIAL DEVELOPMENT

A separate therapeutic product opportunity

Develop a differentiated, quality-controlled candidate supported by disease-specific evidence. The value comes from a defined product, meaningful patient outcomes and owned development data. Partnering, licensing and specialist clinical development are commercial options after validation. This follow-on needs its own regulatory plan, operating budget and financing; the current $1–2M round retains the lead preclinical decision as its priority.

06 / PATENT LANDSCAPE

The broad fatigue use is already disclosed

RU2267319C2 discloses a Bemitil liquid composition and chronic-fatigue treatment method; WO2016089251A1 discloses Bemitil with levocarnitine for asthenia/chronic fatigue. These are material prior art, regardless of whether particular rights remain enforceable. Historical chronic-fatigue terminology does not establish a modern, PEM-defined ME/CFS trial. We make no novelty or freedom-to-operate claim for broad Bemitil use.

07 / IP DEVELOPMENT ROUTE

Earn a specific invention

Patent counsel should chart the existing claims and disclosures before selecting a product. Evaluate genuinely new formulations, delivery approaches or specific treatment methods only when practical differences and supporting evidence justify them. A new mechanism or gene-expression explanation for an old use does not, by itself, create a new patentable use. No Antaeus ME/CFS patent filing is claimed.

08 / ADVANCEMENT GATES

Three decisions before a patient program

First, establish reproducible Bemitil biology, exposure and safety in the lead program. Second, assess disease relevance using existing patient datasets and appropriately authorized patient-derived research. Third, obtain specialist clinical, regulatory and IP review before designing a controlled patient study. Stop the ME/CFS expansion if disease-relevant effects fail to reproduce or safety is unacceptable.

09 / DISCLOSURE + FILING

Preserve the ability to protect new work

This page states a research direction, without a new formulation recipe or treatment regimen. For any actual invention, coordinate filing before enabling public disclosure; disclosure can affect patent rights, especially outside the United States. A provisional application requires adequate supporting disclosure and does not itself grant a patent.
